Terms and Conditions

Last updated: May 2026. These Terms and Conditions govern access to and use of Wasal websites, dashboards, mobile applications, integrations, and related delivery services in Kuwait.

1. Contractual Relationship

By creating an account, placing an order, accessing any Wasal dashboard, or using any Wasal service, you agree to be bound by these Terms. If you do not agree, you must stop using the Services.

2. Service Scope

Wasal provides technology-enabled logistics and delivery operations, including merchant order management, branch operations support, tracking, delivery partner assignment, and customer communication features. Service availability may vary by area, operating hours, and operational capacity.

3. Eligibility and Accounts

You must be at least 18 years old, or the legal age required under applicable Kuwait law, to use the Services. You are responsible for accurate account data, account security, and all activity conducted through your account, including OTP verification and credential usage.

4. License and Ownership

Subject to compliance with these Terms, Wasal grants you a limited, revocable, non-transferable, non-exclusive license to use the Services for their intended purpose. All software, content, marks, and intellectual property remain the property of Wasal and its licensors.

5. Acceptable Use

You must use the Services lawfully and responsibly. You may not misuse accounts, disrupt operations, harass personnel, submit fraudulent orders, or interfere with platform security, infrastructure, or data.

6. Prohibited Activities

You must not:

  • Reverse engineer, copy, resell, scrape, or otherwise exploit the platform without written approval.
  • Use the Services for unlawful goods, banned items, or prohibited shipments.
  • Impersonate others, share accounts improperly, or bypass verification controls.
  • Attempt unauthorized access to systems, APIs, dashboards, networks, or third-party integrations.

7. Orders and Delivery Operations

You are responsible for complete and accurate pickup/drop-off details, contact data, and shipment content declarations. Delivery windows are estimates and may be affected by traffic, weather, demand surges, access restrictions, or force majeure.

8. User Responsibilities and Liability

You are responsible for compliance with Kuwait law during service use. Any penalties, losses, claims, or damage caused by your violation, misdeclaration, negligence, or unlawful use may be charged to you, including indemnification obligations toward Wasal where legally applicable.

9. Pricing, Fees, and Payment

Charges may include delivery fees, distance/time components, waiting, failed-attempt fees, special handling, or service surcharges. Fees are shown according to the active pricing model and may change over time. Payment methods may include cashless and supported local payment channels.

10. Refunds and Adjustments

If an overcharge, duplicate charge, or processing error is confirmed, Wasal may issue a refund or wallet/account credit, based on payment method and operational policy. Fraud-related or abusive refund claims may be rejected.

11. Communications and Notifications

You consent to receive operational and service communications through available channels, including SMS, phone calls, email, push notifications, and WhatsApp where enabled. Communication preferences may affect your ability to receive order and account updates.

12. Privacy and Data Use

Personal data is handled according to the Wasal Privacy Policy. By using the Services, you acknowledge that operational data may be processed to authenticate users, prevent fraud, fulfill deliveries, provide support, and comply with legal obligations.

13. Third-Party Services

Some features may depend on third-party providers (for example payments, maps, messaging, or analytics). Wasal is not responsible for third-party outages or policy changes outside its reasonable control.

14. Suspension and Termination

Wasal may suspend, restrict, or terminate access for suspected fraud, abuse, legal non-compliance, security incidents, payment abuse, or material breach of these Terms.

15. Disclaimer

The Services are provided on an "as available" basis. While Wasal works to maintain reliable operations, uninterrupted availability and error-free performance cannot be guaranteed at all times.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Wasal is not liable for indirect, incidental, special, consequential, or punitive damages. Any direct liability is limited to amounts paid for the specific affected service, except where mandatory law requires otherwise.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Kuwait. Any dispute arising from or related to these Terms or the Services shall be subject to the competent courts of Kuwait, unless mandatory law provides otherwise.

18. Updates to These Terms

Wasal may update these Terms from time to time. Updated versions become effective upon publication. Continued use after updates constitutes acceptance of the revised Terms.
